J. Nye denies an employee's motion for summary judgment and grants an employer's motion for summary judgment in an employment dispute. The employee alleges that pizza delivery drivers were underpaid or not adequately reimbursed for vehicle-related expenses. The regulation is ambiguous, therefore the court yields to agency guidance, which allows the employer various options for calculating reimbursement.

J. Patricco grants the Shoshone-Bannock Tribes and the Fort Hall Business Council's motion to remand this breach of contract action to the Shoshone-Bannock Tribal Court for the Fort Hall Reservation. The case concerns "a casino expansion project within the boundaries of the Fort Hall Reservation," and the parties' agreement for construction management services placed exclusive jurisdiction in the Shoshone-Bannock Tribal Court. The court concludes that the case was "improvidently removed," because the removal statute is inapplicable, as the case was initiated in tribal court. Furthermore, the removal was untimely, and remand is proper "under the tribal exhaustion doctrine."

J. Brailsford grants the dismissal motion filed by the sheriff's office in this lawsuit stemming from an individual's arrest and subsequent detention in the Ada County Jail. The individual contends that he was subjected to a "body cavity search" and asserts claims under Section 1983 for violations of the Fourth and Eighth Amendments. However, the individual plaintiff "fails to allege the requisite facts to hold a municipality liable" under Section 1983. Also, his state law claims must be dismissed against the sheriff's office, as he did not comply with the notice requirement.

J. Winmill denies the inn defendants' dismissal motion in this lawsuit brought by the U.S. Department of Labor alleging that the inn constructively terminated an individual's employment after the individual spoke with a department investigator. The department asserts a retaliation claim under the Fair Labor Standards Act against the inn defendants, as well as an obstruction claim. Their dismissal motion is denied as to both claims, as the current action is not barred by a previous subpoena action.

J. Nye grants a beauty goods company's motion to dismiss or transfer venue involving a matter in which former employees seek a declaratory judgment that they are not bound by the arbitration provision of the Independent Stylist Agreement. The former employees do not have any fatal errors in their complaint, therefore the matter is not dismissed. However, "it would be more efficient for the parties and the judicial system to hear these claims in New Jersey."

J. Nye denies a former employee's motion for attorney fees. His former employer alleged that he breached the employment agreement when he took a job with a competitor. The court found that the severance agreement superseded the employment agreement and “extinguished the obligations set forth in the Employment Agreement and RCA,” therefore he did not breach the employment agreement. However, "the language of the Severance Agreement makes clear that [the employee] cannot recover attorney fees under the Employment Agreement and RCA."
Court: USDC Idaho, Judge: Nye, Filed On: July 18, 2023, Case #: 1:22cv244, NOS: Defend Trade Secrets Act of 2016 (DTSA) - Property Rights, Categories: Employment, Trade Secrets, Attorney Fees
J. Winmill grants the city's motions for judgment on the pleadings regarding a matter where an individual alleged violation of his constitutional rights after he was questioned at length regarding a murder that he eventually confessed to. The individual moved to suppress his confession as a violation of his Miranda rights. The district court granted that motion, finding that law enforcement violated his Miranda right to counsel and coerced the confession. On appeal, the Supreme Court found that the individual's Miranda rights were violated, but his confession was not coerced. "The Fifth Amendment does not directly create a constitutional right to counsel," therefore the court "must follow precedent" and "reluctantly grant defendants’ motions for judgment on the pleadings."

J. Brailsford grants the government's motion to dismiss a citizen's allegations that the government unreasonably delayed processing her mother's visa application. The citizen's mother, a Mexican national, requested an expedited interview before her son turned 21, as he is an “immediate relative” and would be the beneficiary of the citizen's petition once her mother's visa application was approved. The citizen lacks Article III standing as she is not suffering from an injury-in-fact due to the alleged delay. The eleven month delay in processing the mother's visa application is not significant.

J. Groves denies in part an employer's motion for partial summary judgment regarding an employee's allegations of discrimination and retaliation. The employee alleges that after taking FMLA leave, she was demoted, then fired. A genuine dispute exists as to whether the employer willfully violated the employee's FMLA rights when it altered her job duties while she was on leave, therefore her FMLA claims are not time-barred.

J. Winmill denies in part a county's motion for summary judgment regarding an individual's posts on the sheriff's personal Facebook page about an officer-involved shooting death. After the sheriff blocked some of the individual's posts, the individual filed a complaint alleging violation of his First and Fourteenth Amendment rights. The individual did not respond to the county's motion for summary judgment. The sheriff is entitled to qualified immunity on the individual's claims, however the county failed to show that there is no dispute of material fact regarding municipal liability and "did not address the constitutionality of the alleged misconduct."

J. Nye denies the state's motion to dismiss six convicted sex offenders' allegations that amendments to the Sexual Offender Registration Notification and Community Right-to-Know Act have been unfairly applied to them, as they were convicted prior to the amendments. The individuals would have been eligible to petition for removal from the sex offender registry after 10 years, but amendments retroactively subjected them to lifetime registration. The individuals have plausibly alleged that the Act is punitive in effect as it restricts "where they may legally live, 'loiter,' travel, and work," that the Act's restraints are "significant and direct," and that the Act "promotes the traditional aims of punishment."

J. Patricco denies in part the state's motion to dismiss transgender individuals' equal protection claim after Idaho Department of Health and Welfare denied them prior authorization needed to receive genital reconstruction surgeries under Medicaid. The individuals have sufficiently alleged an equal protection claim in demonstrating that as transgender individuals, they "were treated differently than similarly-situated cisgender individuals when, pursuant to Defendants’ policy, they were denied medically necessary genital reconstruction surgery to treat their gender dysphoria."

J. Grasham denies a company's renewed motion for a directed verdict and motion for a new trial in an employment dispute. A jury found in favor of the employee, determining that the company unlawfully retaliated against her in firing her after she discussed filing a complaint for a supervisor's racist remarks about her and his unwanted touching. The company has not shown that the jury's verdict was contrary to evidence presented at trial. Final judgment will be entered in favor of the employee, and she is awarded $300,000 in back pay plus prejudgment interest as well as $130,333 in front pay.

J. Groves denies cross motions for summary judgment between a gold and iron prospecting equipment seller and a competitor in a patent infringement dispute. The Record of Decision is vacated.

J. Winmill grants in part cross-motions for sanctions for spoliation of evidence in a product liability suit after an employee was injured when a forklift failed. The workers compensation insurer alleges that the forklift manufacturer did not return a hydraulic cylinder until after discovery had closed and sold the forklift attachment at issue, and the manufacturer alleges that the insurer failed to preserve daily vehicle inspection reports. The forklift manufacturer did spoliate evidence as the forklift attachment is relevant to the claims at issue and the manufacturer's tests and inspections of the attachment are therefore excluded. The insurer had a duty to retain inspection records because they should have known the records would be relevant to the insurer's defenses. The manufacturer is entitled to a permissive adverse inference that the records would have favored the manufacturer's version of events.

J. Winmill grants in part a company's motion for attorney fees and entry of amended judgment in a contract dispute. The company's "limited success does bear on the reasonableness of its fee request." J. Dale finds a trust's motion for default judgment to be moot in a dispute over a real estate purchase. The trust alleges that the property had defects that were not disclosed. J. Nye grants motion to dismiss an individual's notice of removal in a dispute with a hospital. The hospital brought defamation claims against the individual, who launched a "smear campaign" claiming that the hospital was participating in a “widespread conspiracy to kidnap Christian children and traffic those children to homosexual couples who would then sexually abuse and kill the children.” The individual never appeared in court proceedings and was sanctioned multiple times. The individual filed a notice of removal. The court lacks subject matter jurisdiction and the case is remanded back to state court.
