The hospital argued that it was not responsible for injuries to her infant's brain during delivery. However, the mother presented sufficient evidence in court that the hospital failed to prevent the infant from suffering acute profound hypoxic ischemia prior to and during childbirth, which resulted in permanent brain damage and a diagnoses of quadriplegic cerebral palsy. Reversed.
