In part because the trial court incorrectly determined it was undisputed that a portion of the easternmost part of the owner's property and adjacent unplatted land was owned by the city as sovereign, the trial court's summary judgment order in favor of the city and the neighbors is reversed, and the case is remanded for further proceedings. The trial court's denial of the property owner's motion for attorney fees is upheld without discussion. Reversed.
