J. Kendall partially grants a construction company’s motion for summary judgment on race discrimination claims brought by one of its employees. The employee is a Mexican American man whose coworker used racist language to describe Mexican people and who implied plaintiff was a gang member based on his tattoos and ethnicity. When he complained about this treatment to his employer, he was fired. The court finds the employee has not produced enough evidence to support his discrimination claims, but allows his wage violation claims, according to which the company failed to pay him for all his hours, to move forward.
