J. Kemp finds the trial court improperly convicted defendant for murder, 16 counts of unlawful discharge of a firearm from a vehicle and six counts of attempted murder. From the date of his arrest to when he filed his motion to dismiss for the court's failure to prosecute within one year due to Covid-19 delays and docket congestion, defendant was held for a total of 405 days during which speedy trial was not tolled; this exceeds the 365-day maximum. The state has failed to demonstrate that defendant was brought to trial within the required period, and the Arkansas Supreme Court is “left with no choice” but to dismiss the matter. Reversed and dismissed.
